Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Secuno LLC ("Secuno," "we," "us," or "our") regarding WAPing, our WhatsApp messaging platform (the "Service").

By creating an account, accessing our dashboard or APIs, or otherwise using the Service, you agree to these Terms and our Privacy Policy, Cookie Policy, and Acceptable Use Policy, which are incorporated by reference.

If you use the Service on behalf of a company or other legal entity, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.

Secuno LLC provides the Service branded as WAPing: software and infrastructure to connect WhatsApp-compatible sessions, send and receive messages, automate workflows, and integrate with your systems via APIs and webhooks. Features depend on your plan and configuration.

We may modify, suspend, or discontinue features with reasonable notice where practicable. Maintenance or third-party outages (including WhatsApp) can interrupt the Service. Public pages are not an uptime or security SLA—any specific availability, support, or security commitments apply only if they appear in a signed order form or enterprise agreement.

• You must provide accurate registration information and keep it current.
• You are responsible for safeguarding API keys, passwords, and device sessions. Notify us promptly of unauthorized use.
• You may not share accounts in a way that circumvents plan limits or licensing. We may offer team and organization features under separate terms.
• We may refuse service, close accounts, or require additional verification to reduce fraud or legal risk.

You must comply with our Acceptable Use Policy. Prohibited conduct includes illegal activity, spam, harassment, malware distribution, and attempts to bypass security or rate limits. Violations may result in suspension or termination.

Paid plans are billed according to the pricing published at checkout or in your order. We do not offer a time-limited "free trial" of paid tiers unless explicitly stated in writing for your account; a free-forever tier may be available with published limits.

• Fees are exclusive of applicable taxes unless stated otherwise. You are responsible for taxes imposed on your purchase.
• Recurring subscriptions renew until cancelled in accordance with the cancellation method we provide.
• Refunds are governed by our Refund Policy, including a 7-calendar-day full money-back window for eligible new paid charges, no refunds after that window except where required by law, and no refunds on plan downgrades. See that Policy and your order terms for enterprise exceptions.

The Service, including software, documentation, branding, and content we provide, is owned by Secuno LLC or our licensors and is protected by intellectual property laws. The WAPing name and marks are trademarks of Secuno LLC. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes during your subscription.

You retain rights to your own data and content. You grant us a license to host, process, and transmit your content solely as needed to provide the Service and as described in our Privacy Policy.

Feedback you provide may be used by us without obligation or compensation to you.

Our processing of personal data is described in the Privacy Policy. Where we process personal data on your behalf as a processor (for example, message payloads you control), our Data Processing Addendum applies when executed.

We do not represent that the Service is "GDPR certified," SOC 2 audited, or ISO certified. See Compliance overview for what we do and do not claim during diligence.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. You use third-party networks (including WhatsApp) at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WAPING OR ITS SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE OR TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO WAPING FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT HAD A PAYMENT OBLIGATION.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

You will defend, indemnify, and hold harmless Secuno LLC and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, your violation of these Terms or third-party rights, or your violation of applicable law or WhatsApp/Meta policies.

These Terms remain in effect while you use the Service. You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure for us, or if we are required to do so by law.

Upon termination, your right to access the Service ceases. Provisions that by nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will survive.

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules. Subject to mandatory consumer protections in your jurisdiction, exclusive venue for disputes will be the state and federal courts located in San Francisco County, California, except that either party may seek injunctive relief in any court of competent jurisdiction.

• Entire agreement. These Terms and referenced policies constitute the entire agreement regarding the Service.
• Assignment. You may not assign these Terms without our consent; we may assign in connection with a merger or sale of assets.
• No waiver. Failure to enforce a provision is not a waiver.
• Severability. If a provision is invalid, the remainder remains in effect.
• Export. You comply with export and sanctions laws and do not use the Service in embargoed jurisdictions or for prohibited end uses.
